Hello to All
Just to give everybody a heads up on what has been going on in New Hampshire. On February 18, 2009 the House of Representatives voted to ITL (inexpedient to legislate) House Bill 472 which was a bill to put a 8% tax on the sale of fireworks. At present we have HB322 going to the Senate after being passed with amendment by the House. This bill started out to allow the military at age 18 to be able to purchase fireworks. The amendment that was added will allow all 18 year olds to purchase and ignite. The New Hampshire Fireworks Association (NHFA) worked hard in defeating the tax bill and getting the second bill thru the House.
I will be getting back to you shortly for help getting the bill thru the Senate. We will need letters phone calls and a show of bodies at the Senate committee meeting once schedule. Also hear a representative of your club will be attending the next NHPA meeting, looking forward to meeting him and submitting my application.

To All
SB380 if and when passed will make all vertical tube fireworks legal, a problem with this bill is that they must be tested by the AFSL or any lab approved by the New Hampshire commissioner. This could be very problematic if you happen to order items from a distributor who has his fireworks tested by a lab recognized by the US Consumer Product Safety Commission but not recognized by the New Hampshire commissioner. Retailers will always be playing catch up receiving items, then holding them probably till the next season because of the lag time getting a particular lab approved in New Hampshire.
All testing labs recognized by the US government should also be recognized by New Hampshire. New Hampshire should not try to reinvent the wheel.

Also SB380 should take affect on passage

To All,
Senate Committee meeting went well, everyone was on the same page and all spoke in favor of SB380. Both parts of the bill I had concerns with have been amended. I would expect the bill to come out of committee "Ought to pass with Amendment"
This bill amended to 1)take effect on passage 2) fireworks to be tested to AFSL standards by any lab recognized by CPSC(no commissioner approval needed).
The Journey continues, all steps need to be pro bill
1)Bill gets voted out of Senate committee
2)bill goes to full Senate vote
3)bill crossover to House
4)bill goes to house committee
5)bill voted out of House Committee
6)bill goes to full House vote
7)Governor Signs into law

I guess I should have explained SB380 before all the procedural stuff

SB380 if passed would make all vertical tube, single and multi shot fireworks including heavyweights legal in NH. All angle tube and winged items would still have to be presented to the NH Permissible Fireworks Review Committee for testing.

It looks like at this time this is going to committee? Do we know what the timing of them reviewing this is and is there any way to find out who is on the committee?

SB380 has come out of Senate Committee with a recommendation "Ought to pass with amendment". The vote was 6-0
March 17 the full Senate will vote on SB380. If it passes (which I believe it will)then it goes to House

Sb380 was passed by the full Senate today and now will cross over to the House. I believe it will be going to Criminal Justice and Public Safety Committee. Hopefully within a couple of weeks we will have date, time and location.

From the way the bill reads, this would include shells, would it not? (or is that the ammendment?)

1 New Subparagraphs; Definition of Permissible Fireworks. Amend RSA 160-C:1, V by inserting after subparagraph (d) the following new subparagraphs:

(e) Firework devices up to 500 grams of pyrotechnic composition that:

(1) Have vertical tubes and discharge vertically; and

(2) Are tested to American Fireworks Standard Laboratories (AFSL) standards or equivalent standards approved by the commissioner.

(f) Items that discharge in a non-vertical or an angled tube and winged items shall be presented to the permissible fireworks review committee, established in RSA 160-C:13, to be considered for inclusion on the list of permissible fireworks allowed for retail sale in the state of New Hampshire.

2 Effective Date. This act shall take effect 60 days after its passage.

As per an earlier post the ammendmant is.

I didn't think it applied to reloadable shells, hope I am wrong
